THE IMAGE
IMGhouse supplys a standard agreement for the selling and buying parties to use. This document may be used to regulate the image use and its release (The document is provided as a service to facilitate the sale process. The parties may agree upon using a different image release form, with other licensing regulations by choosing to use the, “Self-defined license” or, by adding further amendments to the supplied standard agreement.
By using the IMGhouse’s standard agreement, the following is also regulated:
The copyright notion emphasizes that, the name of the photographer shall be published next to the published image. The industry praxis allows for an exception though. The image byline may be omitted when the image is used for commercial purposes.
If you, as a member, find an image or a request that is offensive, please report this to the IMGhouse-administrator. We will proceed with the appropriate action.
How the image may be used[Top]
An iamge may be used according to the agreement between the Licenser (Photographer) and the Licencee (Image buyer). The licensing is made exclusively between the two parties without liability, commitment and undertaking by IMGhouse.

Use license of an image[Top]

Royalty-free License
Royalty-free License gives the Licensee, upon payment of a lump sum, the right to use the Image for any purpose and for any number of times. If the Licensee pays for the Image and then delivers it to the Licensee's own customers, the use right of the Image rests with the final recipient of the Image. The Licenser has the right to sell the Image to other image buyers than the Licensee. -
Right Managed (Exclusive Once-Only License)
Right Managed ( Exclusive Once-Only License ) gives the Licensee the right to use the Image in the manner dictated by the Licenser in the premises stated in the above usage description. If the Licensee wishes to use the Image again or in a manner diverging from the established premises, the Licensee must contact the Licenser in order to agree upon additional rights of usage and payment. The Licenser may not sell the Image to others during the stated time period in the specified territory. -
Non-exclusive Once-Only License
Non-Exclusive Once-Only License gives the Licensee the right to use the Image in the manner dictated by the Licenser in the premises stated in the above usage description. If the Licensee wishes to use the Image again or in a manner diverging from the established premises, the Licensee must contact the Licenser in order to agree upon additional rights of usage and payment. The Licenser may sell the Image to others. -
Exklusive License
Exclusive License gives the Licensee, upon payment of a lump sum, the right to use the Image for any purpose and for any number of times. The Licenser may not sell the Image to others. -
Self-defined License
Self-defined License gives the Licensee the right to use the Image in accordance with use rights set forth in a separate contract agreement referred to by the Licensee.
By using the IMGhouse’s standard agreement, the following is also regulated:

Model release
If the image has a model release, the photographer is assured that there is a proper clearance from prominent, identifiable faces of the portrayed models (persons) in the image. A model release is necessary for commercial use, but not for editorial use.
- Image Byline The image buyer is responsible for assuring that there is an image byline when publishing the purchaced image. According to industry praxis, an image byline may be omitted for commercial image usage.

Re-selling of an image
The image buyer may, under no circumstances, re-sell the image to a third-party without consent from the photographer.

Image manipulation
The image buyer may make appropriate changes and manipulations to the image if these changes does not violate the integrity of the photographer and/or lawful regulations.
Model release[Top]
If a person's face is prominent and identifiable in an image, the models (persons) must agree and give the consent for using the image for commercial purposes. Such an agreement is called a Model Release. It is necessary for the publisher to be assured that the photographer, has aquired the model release. If in doubt, the publisher should contact the photographer and ask for a written copy of the model release.
An image that is used in editorial purposes does not need a model release.
Copyright & Image byline[Top]
Images are subject to copyright, which means that an image buyer is buying a license to publish the image, while the photographer maintains the copyright and the non-profit right of the image. This means that the ownership of the original image and all of its further uses, except for, in the case of a consented agreement, belongs to the photographer. An image that is not categorized as photographic art is protected by copyright law for 50 years after the year of publishment (otherwise it is protected for the next 70 years following the death of the photographer/artist).

Report the image[Top]
At IMGhouse we do not accept either images or requests that are in any way offending. This includes infringement of copyrighted material and the offending of any ethnic group(s), individuals, public persons or images that are of a pornographic and or racist character. We also do not accept images that are in violation of national or international laws.
If you, as a member, find an image or a request that is offensive, please report this to the IMGhouse-administrator. We will proceed with the appropriate action.
BUYER
Registering to become a member is free and it only takes less than one minute!
This freemium account service enables you to publish your image requests for free. A commission is paid to IMGhouse from the photographer when an image is sold. When publishing a request, you are not bounded to buy any images, if you don't find what you are looking for. After you have created your account, you have the possibility to upgrade to a premium account. You are entitled to increased services, including amongst others: the downloading of sketch images and the possibility to receive 30 days invoicing. A premium account is priced at 3 000 SEK / year.
You can decide what you want to pay for the image by basically, setting your “fixed price bid” for the image. Photographers will then upload their photos which meet that maximum value. You can also set a “minimum price” and indicate that as the starting price for the category of images you are looking to purchace. This will allow you to see a wider range of images . you don't have to make up your mind until you seen all of the images.
To publish an image request is for free. You are not bounded to buy any images, if you don't find what you are looking for. You are paying after you have made up your mind to download the image in (specified)high resolution for publishing.
At IMGhouse, you may find images costing from 300 sek or for 10 000 sek. It all depends. We have all type of photographers; freelance photographers, hobby photographers and image stock agencies. The price within your budget is reflecting the kind of images and the amount of images that you may get to your request. You are always in charge of your request and what price you want to pay. Consider though that high quality images are more expensive. A photographer dedicating time to produce an image wants to get paid for the work. There are industry guidelines for what images may cost, among others, the Swedish Picture Suppliers Association publish the BLF price list. Contact us for more information.
IMGhouse takes a commission from the photograher of 20 – 35%, but minimum 150 SEK. Our commission is about half of the standard image stock agency commission of 50 – 60%. We want to benefit both you as a buyer and the photographers as sellers.
The image market has developed a new kind of license during the last years where photographers and image stock agencies are selling the images to a fixed price and letting the buyers use the images in any way appropriate without limitation in time. These images has a Royalty-free License and may be sold to many buyers. Note that these images may be marketed on several selling channels simultanously.
The license for publication is always your own decision. Just know that you will reach different groups of our photographers depending on what license and pricing you are choosing.
If the uploaded images are not matching your intentions it may be that your request is not clear enough and that you need to be more specific in your description. You may update your request and leave comments with the communication tool found by your request. The photographers may also use the communication tool to ask you questions. If that happens, you will then receive an e-mail.
It is forbidden at IMGhouse to publish requests regarding images that in any way is of offending character. This includes infringement of copyrighted material and offending of any ethnic group, single individuals, public persons or images that are of a pornographic and racist character. We also do not accept images that are of pornographical and of racist character, and moreover, images that are in violation of national or international law. Beside that we may delete your request, we might close your member account. We co-operate with the police enforcement regarding illegality and criminal investigation.
Membership[Top]
To use the services of IMGhouse you need to register and become a member. You are welcome to register with us as a member whether or not you are buying images every once in a while, or, purchasing them on a regular basis.

Your request[Top]
No matter if you know exactly what you are looking for, or only have a vague sense of what you want, you may publish an image request. In the first case, you describe precisely to the photographers what you have in mind, and in the second case, you may use the crowdsourced creativity of the photographers that may give you many possible solutions to your request. In your request you may specify the technical aspects of the image such as size, resolution and the orientation of the image. You can also specify the deadline when you need the image. However, since you are buying the right to publish the image, you also need to specify your intended use and choose a suitable image use license.

Image license and Contract[Top]
Traditionally, it has been important for the professional photographers and the image stock agencies to know what your intended image use is before you may get a price quote. These kind of images are sold with an exclusive license. The license may be a Right-Managed License where the photographer may re-sell the image after a agreed past time frame and you may use the image in a pre-defined use scenario. The license may also be a buyout of the image which means that you may use the image in any appropriate way and the photographer may not re-sell the image.
The image market has developed a new kind of license during the last years where photographers and image stock agencies are selling the images to a fixed price and letting the buyers use the images in any way appropriate without limitation in time. These images has a Royalty-free License and may be sold to many buyers. Note that these images may be marketed on several selling channels simultanously.

Keep updated of new images[Top]
In the settings of your member account you may set if you want an e-mail for every image uploaded to your request.
If the uploaded images are not matching your intentions it may be that your request is not clear enough and that you need to be more specific in your description. You may update your request and leave comments with the communication tool found by your request. The photographers may also use the communication tool to ask you questions. If that happens, you will then receive an e-mail.
If you have a Premium account you have the option to pay by invoice. If you have a Freemium account, you may use your credit card to pay for the image. We do not save nor store credit cards' information. The payments are handled by Samport, one of the largest payment solution in Sweden, providing safe online payments.

IMGhouse is providing with contact details between the two parties. IMGhouse is not a liable part in the contract and is not under any circumstances liable for any reimbursement. If you are not content with the image, you should contact the photographer.

SELLER
The membership to use the standard services on the site is for free. To register as a member takes less than one minute!
After the creation of your member account you will have the opportunity to upgrade to a premium account which is an account with additional services. Among others, you are enjoying a lower commission rate; you pay 20% instead of 35%. The premium account is costing 1 200 sek/year. Your membership account is personal and you may only upload images created by yourself or have the permission to sell to third parties. To be able to upload images, you need to fill in your personal data. You reach your profil page under the tab account.
In the settings under the tab account, you may save a set of keywords. You will then receive an e-mail if your keywords is matching a new requests.
When you upload an image, you may state additional terms in addition to the license of use that the image buyer has stated. You may also ask for a higher price for your image if the image buyer has stated that s/he accepts a higher price bid.
The image buyer has 30 – 90 days after the request deadline to decide which image to buy. There is no warranty that your image will get sold. If the customer doesn't find what s/he is looking for, s/he may not buy any of the images.
IMGhouse register all sales on the site and we are in assistance of the payment transaction for the images. IMGhouse apply reversed invoicing. This means that it's IMGhouse who creates the invoice/receipt for the photographer. Freelance photographers get an invoice where the Swedish VAT is added and the accounting is carried out in the firm. Hobby photographers recieves a receipt without VAT and declares the sale on the personal yearly income declaration as a hobby activity.
IMGhouse takes commission on the image sale when you get an image sold. We take 20% if you have a Premium account and 35% if you have a Freemium account. The payment from the sale is available for reimbursement 30 days after the payment from the image buyer has been collected.
For IMGhouse to be able to make a payment, you need to state your bank account number inclusive the clearing number or alternatively state your PayPal-account. You find this setting on the tab account.

IMGhouse is not a liable part in the contract and is not under any circumstances liable for any reimbursement of the commission.
Just remember that it's important that your customer is content with your work. If you have delivered an image that is not meeting the requirements stated in the license agreement, you then have made a breech to the agreement. If they image buyer for some reason is not content with the bought image and something needs to be corrected, it's your responsibility as the photographer, together with the image buyer, to deal with the problem and to find a solution.

Exceptions to these guidelines is of course if there exist an artistic thought behind your choice to break these guidelines.
Improve the possibility for a sale
Digital images often needs to be adjusted before they can be delivered as the final image. In image programs such as Photoshop, Elements, Lightroom or Aperture, you should adjust the settings for levels, curves, saturation, lightness, contrast, and more.
A good image is very much about composition and expression. To make your image perfect in the after work, you may use the cropping and the rotating tool to make skewed horizontal lines straight and to crop away non-necessary space or unwanted objects. Have in mind though that your image will reduce in size and/or resolution when you are using the crop tool.

Keep updated of new requests[Top]
There are several ways to keep updated with new requests. Either you surf into IMGhouse regulary or you may keep updated through our RSS-feed: http://imghouse.se/image/rss
In the settings under the tab account, you may save a set of keywords. You will then receive an e-mail if your keywords is matching a new requests.
Uploading of an image[Top]
When you have an image suiting the description of a request, you may upload max 3 images. We use this restriction because we want the images to be the “right” images. With other words, it is about quality rather than quantity.
When you upload an image, you may state additional terms in addition to the license of use that the image buyer has stated. You may also ask for a higher price for your image if the image buyer has stated that s/he accepts a higher price bid.
Sale[Top]
If you get an image sold, you will receive an e-mail.

Archiving[Top]
You may find the information of all the images that you have uploaded in your member account. The high-resolution images are only saved temporarily on our servers. We delete them when the images are no longer up for sale. Only the thumb images are stored on our servers for future reference.

Tips to the photographer[Top]
Unwanted imagesA photographer that is professional should not upload:
- underexposed images (too dark, black areas without coverage)
- overexposed images (för ljust, vita partier utan täckning)
- images with faulty focus (out of focus or focusing on the wrong object)
- images that are better to keep in your family album such as simple portraits and personal vacation images
- protected copyrighted material such as logotypes and images reproducing an artist's work
Exceptions to these guidelines is of course if there exist an artistic thought behind your choice to break these guidelines.
